49 CFR and roadside enforcement references

Federal rules under 49 CFR 391.11(b)(2) require a commercial motor vehicle driver to read and speak English well enough to communicate with the public, understand highway traffic signs and signals, respond to official inquiries, and make entries on reports and records.

Effective June 25, 2025, CVSA designated non-compliance with 49 CFR 391.11(b)(2) as a driver out-of-service violation. FMCSA also states that carriers should assess whether drivers can communicate with law enforcement during roadside inspections and understand highway traffic signs and signals.
